This Acceptable Use Policy ("AUP") defines what Content and behaviour in the NEXON Vision service are not acceptable. The AUP forms part of the Terms of Service (the "Terms").
Compliance with this AUP is a mandatory condition of using the Service. Terms used in this AUP have the meaning defined in the Terms.
All restrictions of this AUP apply to the Customer, its Users, and Content uploaded, displayed, or broadcast by the Customer through the Service.
1.1. NEXON provides a technical platform for Digital Signage management. The Customer is solely and fully responsible for all Content uploaded, displayed, or broadcast by the Customer or its Users through the Service.
1.2. The Customer warrants that its Content and use of the Service comply with all applicable laws, including (but not limited to) advertising law, intellectual property law, consumer protection law, data protection law (GDPR), the EU Digital Services Act (Regulation (EU) 2022/2065), and special legislation regarding specific categories of goods and services.
1.3. NEXON does not perform prior legal moderation of Content and does not verify the existence of licences, permits, or approvals. NEXON's discovery of obvious violations of this AUP or applicable law gives NEXON the right to restrict access to Content, suspend, or terminate the Services as provided in the Terms.
Regardless of applicable law, the following Content is prohibited on the Service:
Pornographic, erotic, or sexually explicit Content of any kind. The Service is used for broadcasting in public places, so such Content is prohibited regardless of the nature of the Customer's location.
Any advertising or promotion of tobacco products, electronic cigarettes, heated tobacco systems (IQOS, GLO, and similar), nicotine pouches, and analogous products. Tobacco advertising is heavily restricted across the EU; this prohibition is absolute regardless of any licences held by the Customer.
This prohibition does not apply to historical, educational, news, or analytical Content covering aggression without justifying it.
3.1. Certain categories of Content — advertising of alcohol, medicines, medical services, gambling, betting, cryptocurrencies, investment products, political advertising, religious content, music, video, and other intellectual property — are governed by special legislation in the EU and in the country where the Content is broadcast.
3.2. The Customer broadcasting such Content through the Service is solely responsible for holding the necessary licences, permits, and approvals and for compliance with all special requirements. NEXON does not verify these conditions.
3.3. The display of music, video, or other intellectual property in public places may require separate licences from rights holders or collective management organisations. Obtaining such licences is the Customer's obligation.
Regardless of the nature of Content, the Customer may not:
4.1. Reverse engineer, decompile, or disassemble the Service or attempt to obtain the source code.
4.2. Use bots, scripts, scrapers, or other automated means to access the Service outside the officially documented API and established limits.
4.3. Exceed rate limits, Plan limits, bypass technical protections, licence checks, or feature restrictions.
4.4. Conduct DDoS attacks, load testing, or other actions creating excessive load on the Service without prior written approval from NEXON.
4.5. Publicly disclose Service vulnerabilities before they are remedied; vulnerabilities should be reported to [email protected].
4.6. Use the Service or NEXON's infrastructure for cryptocurrency mining, proxy servers, VPN nodes, exit nodes, distribution of spam, phishing, malware, attacks on third parties, or other purposes unrelated to Digital Signage management.
4.7. Transfer credentials to third parties, sell, or transfer access to the Service outside the Terms.
5.1. The Customer and its Users must act in good faith and not use the Service or NEXON's support functions for:
5.2. The Customer must ensure that all of its Users comply with this AUP.
6.1. Any party that considers Content broadcast through the Service to violate this AUP, its rights, or applicable law may submit a notice to s[email protected].
6.2. The notice must contain: - a link to the Content or sufficiently detailed description to identify it; - a description of the alleged violation; - evidence (where available); - contact details of the notifier; - a declaration in good faith that the information provided is accurate and complete.
6.3. NEXON shall process notices in a timely, diligent, non-arbitrary, and objective manner in compliance with Article 16 of the EU Digital Services Act.
6.4. The procedure for handling notices, statements of reasons, and appeals is set out in Section 5.3 of the Terms.
7.1. In case of violation of this AUP, NEXON may apply measures provided in the Terms, including removal of Content, suspension of the Account, termination of the Terms, and retention of paid amounts where provided in the Terms.
7.2. The grading of measures and procedure for their application are set out in Sections 7.1–7.3 of the Terms. The Customer is liable for damages caused to NEXON by AUP violations under Section 5.4 of the Terms.
NEXON may update this AUP under Section 14 of the Terms. Material changes are notified to Customers at least 30 calendar days in advance through the Service or email.
The date of the last update is shown at the top of this document.
This AUP is published in English. NEXON may publish translations into other languages for convenience. In case of any discrepancy between the English version and any translation, the English version prevails.
